Emma is specialist in family law for over 15 years and has spent much of her career to date specialising in children and financial matters, including high conflict proceedings.

Emma gains the trust and confidence of her clients by providing clear advice, options and strategy throughout whether within or outside a court process. Emma’s practice has been built on her commitment to the cases she is instructed on and her firm, but friendly and empathetic, approach to clients and their circumstances.

Emma has an LLM in Child Law and has a particular interest in private law children matters and has been instructed in a number of complex children matters acting for mothers, fathers and grandparents. In particular, Emma has considerable experience in domestic and international relocation.

In relation to financial matters, Emma is regularly instructed by clients with various levels of assets from medium to high net worth within the UK and abroad, often giving rise to considerations of jurisdiction and enforcement.

Emma is regularly instructed on matters concerning the rights of unmarried couples involving disputes over interests in property (TOLATA) and financial provision for children.

Emma is a committed member of Resolution, Chair of South West London Resolution and an Accredited Specialist in complex financial matters and private law children.

Emma is also a Resolution trained ‘all issues’ Family Mediator working towards accreditation and is also trained as an Advanced Hybrid Mediator – she is adept at working with couples across a range of issues relating to their separation, divorce, communication, children and financial matters. Q&A with Emma Post

Can you tell us about your background and experience?

I went to a comprehensive school and was the first of the family to go to university. I’d always liked the idea of being a lawyer, but a teacher told me that I should read a subject I loved at University. So, I read Politics at the University of Southampton and it was on my gap year (whilst travelling) that I decided to do my GDL and LPC. I trained and spent a number of years at a niche litigation firm in North London, during which time I also obtained my LLM in Child Law. I then moved to a boutique family law firm in Kingston, before taking a partnership role in Windsor. During my second maternity leave, Nicki and I made the decision to launch our own firm.

What inspired you to specialise in family law?

Firstly, without doubt it was the human element – it is a huge privilege to be able to support and guide people through such difficult times and every case is different. Secondly, the breadth of knowledge. Family law is one of the only areas of law, that encompasses so many other areas. It’s often seen as the soft option, it’s far from that.

How do you approach working with clients?

My approach is straightforward. I listen, give clear and, if necessary, robust advice. Clients need to be empowered to make informed decisions and telling them what they need to hear, rather than what they want to hear, is really important. I’m a firm advocate of non court dispute resolution and always explore these and keep them under review. Above all, I bring patience and kindness.

Why is getting legal advice when you separate or divorce so important?

Knowledge is everything. You may not have made a decision about your relationship, you may be at the start of your separation or have already separated. The earlier you can have an understanding about your legal position, and share what’s important to you, in order to understand what you should be thinking about – the better. There are many practical, emotional and financial considerations and it’s more costly to undo mistakes in the long run.

Tell us something not many people know about you?

I really want to learn to play the Harp! When I was planning my wedding, I decided quite last minute I wanted a harpist – you can imagine how thrilled my (now) husband was with being tasked with this quite late on, particularly as we were getting married abroad! Ever since then, I’ve wanted to learn.

Where can you be found at the weekends?

I am surrounded by energetic boys, so we can be found walking our beloved Cockerpoo, Monty, in Richmond Park or otherwise at the side of a football/rugby match watching my two young sons. If I can sneak in a trip to the gym, a yoga class or a walk alone with a podcast, all the better.
